New draft legislation for ICS2 (Release2, 1 March 2023) to be published in Q4/2022
The EU Commission’s “𝘚𝘪𝘮𝘱𝘭𝘪𝘧𝘺𝘪𝘯𝘨 𝘤𝘶𝘴𝘵𝘰𝘮𝘴 𝘧𝘰𝘳𝘮𝘢𝘭𝘪𝘵𝘪𝘦𝘴 𝘢𝘯𝘥 𝘪𝘮𝘱𝘳𝘰𝘷𝘪𝘯𝘨 𝘵𝘩𝘦 𝘐𝘮𝘱𝘰𝘳𝘵 𝘊𝘰𝘯𝘵𝘳𝘰𝘭 𝘚𝘺𝘴𝘵𝘦𝘮 2” #initiative amends the #rules on #customs formalities to make the #declaration of goods easier and faster. It also supports #implementation of the EU’s new pre-arrival #security and #safety programme for #effective risk-based customs #controls whilst facilitating the free flow of #legitimate #trade across the EU’s #external borders (Import Control System #ICS2).
The #Commission is working together with the dedicated Customs Expert Group to prepare the required #legislation (“delegated acts”) and is expected to release the #acts in the fourth quarter of 2022.
𝗔 𝗿𝗲𝗺𝗶𝗻𝗱𝗲𝗿: 𝘁𝗵𝗲 𝗜𝗺𝗽𝗼𝗿𝘁 𝗖𝗼𝗻𝘁𝗿𝗼𝗹 𝗦𝘆𝘀𝘁𝗲𝗺 (𝗜𝗖𝗦𝟮) 𝗮𝗻𝗱 𝘄𝗵𝘆 𝗶𝘁 𝗶𝘀 𝗻𝗲𝗲𝗱𝗲𝗱
Customs pre-arrival security and #safety #programmes use electronic advance data (#EAD) to #enhance the security of #international #supplychains. In the EU, customs #authorities have implemented a system requiring the advance #submission of a #digital Entry Summary Declaration (#ENS) at #consignmentlevel. These ENS filings must be pre-lodged in the Import Control System (ICS2).
Two types of #riskanalysis are performed for goods entering into the EU:
–Pre-loading risk analysis, focusing solely on #transport #security; and
–Pre-arrival risk analysis, focusing on all types of risk, e.g., transport security, #productsafety, #IPR, etc. (using the full Entry Summary Declaration (ENS)).
𝗡𝗲𝘅𝘁 𝗽𝗵𝗮𝘀𝗲 (𝗥𝗲𝗹𝗲𝗮𝘀𝗲𝟮) 𝗼𝗳 𝗜𝗖𝗦𝟮 𝗲𝗻𝘁𝗲𝗿𝘀 𝗶𝗻𝘁𝗼 𝗳𝗼𝗿𝗰𝗲 𝗼𝗻 𝟭 𝗠𝗮𝗿𝗰𝗵, 𝟮𝟬𝟮𝟯
–Release 1 entered into force on 15 March 2021: ICS2 became mandatory for #airtransport for both #express and #postal #shipments, and focused solely on pre-loading risk analysis for air transport. It requires #submission of a reduced ENS #dataset (only 8 #data elements –“Pre-loading advance cargo information”, or PLACI).
–Release 2 will enter into force on 1 March 2023: It will focus on both pre-loading and pre-arrival risk analysis, and the full ENS #dataset will be required. The #scope of the #application remains limited to air transport.
–Release 3 (due to enter into force on 1 March 2024) will require #submission of a full ENS dataset for all transport modes, including sea/road/rail.
